Motor vehicle accidents may involve drowning due to negligence

Sadly, two men lost their lives in a recent South Carolina car crash involving a single motor vehicle. The motor vehicle accident took place on a Saturday. Authorities found the two men in a pond at the accident scene. Sometimes, these types of motor vehicle accidents occur due to driver negligence, which is grounds for litigation.

According to police, someone contacted the authorities to report that a car was in a pond. About 10 hours later, authorities pulled two bodies from the pond. The car in which they had been riding before they drowned was 18 feet below in the water.

A deputy coroner ended up identifying the men on the Sunday following their discovery. They were 23 and 26 years old at the time of their deaths. Police did not say what had led the car to enter the pond.

If the police investigation reveals that the car driver's carelessness caused the accident -- for example, perhaps the driver was driving too fast for road conditions or was driving under the influence -- then the surviving loved ones of the deceased passenger may opt to file a wrongful death claim, seeking damages. Even though the car driver died in the accident as well, this man's estate can still be sued, and so can anybody else with an ownership interest in the submerged car. Competent proof of negligence is needed to establish liability before the civil court hearing the case in South Carolina. A successfully fought case might lead to a monetary award that may help with covering funeral costs and other losses, such as the loss of income for surviving dependents, associated with these types of motor vehicle accidents.
