Motor vehicle accidents may happen as a result of negligence

A collision has tragically snatched the lives of two men in South Carolina. The accident took place on a Friday night. These types of motor vehicle accidents may occur due to a driver's carelessness, in which case the negligent driver may be held financially responsible for the injuries and deaths that occurred as a result.

According to police, a single automobile left the roadway and entered the woods before finally coming to a rest sideways. Several crews were called to the accident scene after being alerted that the wreck involved entrapment and ejection. In fact, they had to remove trees to reach the wrecked car.

A battalion fire chief confirmed that the two men, ages 44 and 30, had died in the collision. Meanwhile, a third party suffered injuries in the collision and was transported to a medical center. The highway where the accident took place was not reopened until early the next morning.

A police investigation may yield information about who was at fault in the collision. If the injured party was behind the wheel when the accident happened, the surviving loved ones of the two men who died in the crash may decide to file wrongful death claims against him, seeking damages. However, if one of the deceased men was the driver, his estate and anyone else with an ownership interest in the car may face a wrongful death claim and a personal injury claim. Liability, based upon a showing of negligence, must be established before claims for damages will be determined in South Carolina civil cases involving these types of motor vehicle accidents.
